Welcome to Plexality. These Terms of Service ("Terms") govern your access to and use of the Plexality platform, including our website, personality assessments, PLEXAR AI, and related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our Services, you confirm that you:

• Are at least 16 years old (or the age of majority in your jurisdiction, whichever is higher)
• Have the legal capacity to enter into these Terms
• Are not prohibited from using the Services under applicable laws
• Agree to our Privacy Policy

If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Age Requirements

You must be at least 16 years old to use Plexality.

If you are under 18 years old (or the age of majority in your jurisdiction), you must have your parent or legal guardian's permission to use our Services, and they must review and agree to these Terms.

We do not knowingly collect or solicit personal information from anyone under 16 years of age. If we learn we have collected personal information from a child under 16, we will delete that information promptly.

3. Important Disclaimers

3.1 About Our Personality Assessments

Our assessments are based on established psychological frameworks including the Big Five personality model. However:

• Results are probabilistic indicators, not definitive diagnoses
• Personality is complex; no test captures the complete picture
• Results should be interpreted with context and self-reflection
• We do not claim to predict behavior with certainty
• Our assessments are designed for personal growth, not clinical evaluation

3.2 About PLEXAR AI

PLEXAR is an AI-powered relationship coach. PLEXAR is not a real person and cannot replace human judgment or professional advice.

• AI responses are generated based on your personality profile and conversation context
• Responses may contain errors, biases, or inappropriate content
• Do not rely on PLEXAR for important life decisions without consulting qualified professionals
• PLEXAR cannot provide emergency mental health support

4. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your information if it changes
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

You may not share your account credentials or allow others to access your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Prohibited Uses

You agree NOT to use Plexality for:

5.1 Employment & Screening

• Pre-employment screening or hiring decisions without proper validation studies
• Performance evaluations or termination decisions
• Discriminatory practices based on personality traits

5.2 Unauthorized Assessment

• Assessing others without their knowledge or consent
• Sharing others' personality data without permission
• Creating profiles for individuals under 16 years old

5.3 Harmful Purposes

• Stalking, harassment, or manipulation of individuals
• Creating fake profiles or impersonating others
• Exploiting vulnerable individuals
• Any illegal activities

5.4 Professional Misrepresentation

• Presenting our assessments as clinical diagnoses
• Using PLEXAR responses as professional medical, legal, or financial advice
• Representing yourself as a licensed professional based on platform features

5.5 Technical Misuse

• Scraping, harvesting, or extracting user data
• Reverse engineering our AI models or algorithms
• Attempting to circumvent security measures
• Introducing malware, viruses, or harmful code
• Interfering with platform operations

6. Intellectual Property

6.1 Our Ownership

Plexality owns all rights to the platform, assessments, algorithms, AI models, archetype system, and related intellectual property. "PLEXAR," "Plexality," "PLEX Profile," and our 33 archetype names are proprietary. You may not copy, modify, reverse engineer, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of content you submit (profile information, conversations). By submitting content, you grant us a limited, worldwide, royalty-free license to use your content to:

• Provide and improve the Services
• Generate personalized insights and recommendations
• Create anonymized, aggregated data for research

This license ends when you delete your content or account, except for anonymized data already created.

6.3 Your Assessment Results

Your personality profile and assessment results belong to you. You may share your results as you choose. We may use aggregated, anonymized results for research and platform improvement.

7. Payment & Subscriptions

Certain features require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your subscription
• Provide accurate billing information
• Authorize recurring charges until you cancel

Subscriptions automatically renew unless cancelled before the renewal date. Refunds are provided in accordance with our Refund Policy. Payments are processed by Stripe; we do not store credit card information.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEXALITY PROVIDES THE SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
• WARRANTIES THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, ACCURATE, OR RELIABLE
• WARRANTIES REGARDING THE SECURITY, ACCURACY, OR COMPLETENESS OF ANY CONTENT
• WARRANTIES THAT RESULTS FROM THE SERVICES WILL BE SUITABLE FOR YOUR PURPOSES

You accept that use of the Services and AI-generated content is at your sole risk. You will not rely on personality assessments, compatibility analyses, or PLEXAR AI responses as a sole source of truth or as a substitute for your own judgment and professional advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLEXALITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, or business opportunities
• Emotional distress or reputational harm
• Damage to relationships or personal decisions made based on our Services
• Loss of data or content

Liability Cap: In no event shall our total liability exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months preceding the claim.

Relationship Decisions: We are not responsible for any decisions you make regarding personal relationships, employment, team composition, or other life choices based on our Services.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Plexality and its affiliates, officers, directors, employees, and service providers from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms or applicable laws
• Decisions you make based on personality assessments or AI recommendations
• Your infringement of any third-party rights
• Content you submit to the platform

11. Acknowledgment of Risks

By using Plexality, you acknowledge and accept:

11.1 AI Limitations

• AI-generated content may contain errors, biases, or inappropriate responses
• Personality assessments are probabilistic, not deterministic
• Compatibility analyses cannot predict relationship success with certainty

11.2 Data Privacy

• Despite our security measures, no system is completely secure
• Third-party AI providers process your conversation data
• Pseudonymized data may be potentially re-identifiable in certain circumstances

11.3 Alpha Testing

• Features may change or be discontinued without notice
• You may encounter errors, bugs, or service interruptions
• Your feedback helps us improve the platform

12. Termination

By You: You may terminate your account at any time through account settings or by contacting us.

By Us: We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason with notice where practicable.

Effect of Termination: Upon termination, your right to use the Services ceases. Your data will be handled according to our Privacy Policy and data retention practices.

13. Changes to Services & Terms

We reserve the right to:

• Modify, suspend, or discontinue any features or the entire Service
• Change pricing for premium features with 30 days' notice
• Update these Terms with notice provided through email or platform notification

Your continued use of the Services after changes constitutes acceptance of the updated Terms. If you disagree with changes, you should stop using the Services and close your account.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal claim, you agree to contact us at legal@plexality.com to attempt to resolve the dispute informally.

14.2 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.3 Arbitration Agreement

Any disputes relating to these Terms or the Services will be resolved by binding arbitration under the rules of the American Arbitration Association, rather than in court, except that either party may seek injunctive relief in court for intellectual property matters.

14.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

15. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Plexality.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Our failure to enforce any provision does not waive our right to do so later.
• Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.
• No Agency: No agency, partnership, or employment relationship is created by these Terms.
